Mr. Benson's practice centers on commercial real estate and business transactions. His extensive real estate experience includes land use, zoning, subdivision, financing, acquisition, title, fractional (TIC) ownership, leasing, licensing and sale of real property interests. Mr. Benson also assists clients in tax related real estate transactions, including like-kind (1031) exchanges, conservation easements and tax credits. In his business practice, Mr. Benson represents private business owners in all matters of formation, operation, merger, acquisition, and sale. Transactional experience of Mr. Benson includes:

• Represent self storage/mini warehouse developer/owner/operator in single closing to acquire ownership interest in 70 properties located in multiple states
• Negotiate and draft transaction documents for real estate holdings of national telecom providers, including office/retail leases and tower, co-location agreements
• Assist ranch owner in grant of conservation easement, including negotiation of conservation easement terms with land trust, coordination of underlying appraisal and property condition reports, and sale of resulting conservation tax credits
• Represent seller of professional service business assets, including draft and negotiate Asset Sale Agreement, employment agreements, and related closing documents
• Counsel for buyer of assets from international manufacturer, importer and wholesaler/distributor of fishing tackle, including entity planning and formation
• Assist developer of fractional ownership/tenant-in-common (TIC) properties, including drafting of TIC ownership and management agreements
• Provide general representation of regional medical/industrial gas distributor, including negotiation of vendor agreements with international suppliers

Mr. Benson received his law degree from Notre Dame Law School, where he also completed the Concannon Programme of International Law in London, England. He earned a masters degree in taxation (LL.M) from the University of Denver. Mr. Benson joined HKH after being a shareholder in his own firm and in the Denver law firm of Robinson Waters & O'Dorisio. Mr. Benson is a member of the Colorado and Denver Bar Associations, and is licensed in Colorado and North Carolina.
